The situation
Long-tenured contractors were working full time, to fixed hours, using company equipment.
In three of the nine countries that is an employment relationship, and back-contributions, penalties and permanent-establishment risk had been accruing for over two years.
What we did
- 1Reviewed every contractor against each country's classification tests.
- 2Moved those who failed onto compliant local employment through our employer-of-record entities.
- 3Rewrote agreements for the genuine contractors so the position is defensible.
- 4Checked whether the work done in each country had created a taxable presence for the company.
The outcome
An estimated EUR 0.9m of back-contribution and penalty exposure closed out before any authority raised it.
Payroll running in-country from the following month, with no change for the people doing the work.
